My wife called the police (911) when we argued loudly over our son of 18 months old. The night before while in our car in a supermarket, she slamped our door (while my infant son sat in his car's chair) out of anger because I complained she should put the cap on the baby's milk bottle. She told the cops that I hit her (NOT TRUE) and there were a few scratches on her arms because of leaning against our apartment's sandy wall while talking to the dispatcher. This happened 2 1/2 months ago, and my wife took my son along with her belongings heading for a women's shelter. This took place while I was in jail (for 3 days for a misdeameanor Class C charge) because of her vicious accusations. She arrived to the U.S. in August 2004 on a K-1 VISA. We married in September and filed the I-485 in September also. As a result, we missed our first I-485 Adjustment of Status interview on Feb. 24, 2005. I also didn't complete the Affidavit of Support (Form I-864) on her behalf. She just arrived here from Vietnam in August. We also just moved from Madison (WI) to Houston (TX) while the interview supposed to take place in Madison. My questions are
(1) What will happen if we missed the first interview?
(2) Can she file it alone while staying in the shelter?
(3) If I-485 is denied, can she stay in the U.S. with me (I am an American citizen since 1988)?
(4) My son is also on her Vietnamese passport but he also has his U.S. passport, can she take my son to Vietnam without my knowledge or permission?
(5) Will the Immigration office know that our marriage is rocky (because we're separated and I was arrested because of her)
(6) Should I continue this relationship or file for a marriage dissolution? What will happen to her?
