I live in california have primary physical custody of my two kids dad has them approxamately 67 days a year. I want to modify child support to reflect that, my new husband makes good money will this hurt me, my ex is under assumption because i remarried and he makes(my cuurent husband) good money this should alleviate if not substantially lower his child support, I also work part time. My ex works full time.

Your new spouses income has no bearing on how much child support will be set at. He isn't responsible for the children. Your income can be imputed to reflect what you would make if you were working full time though.

ditto what cerea said. your new spouses income has no bearing on your CS but your income can be imputed at full time.

I went to court last sept. with an attorney mind you, and the judge added my husband income with mine, putting my income substantially higher, even if i worked full time i would never even come close to making that kind of money, the judge wouldn't even give me a hardship for my daughter that me and my husband share, he said he hardly calls it a hardship since I live with the father, my husband...he even put my ex's time at 32%. 67 out of 365 days and he called that 32%! he suppose to have them 67 days but he never has i even had calanders to show it he addmitted on the stand to never taking his holidays or vacations or even an extra day! I left feeling violated by the system add insult to injury i had to pay my attorney..I was thinking of going through the child support department I hear they don't consider the new spouses income to modify the support because i think they would be impartial unlike the judge at least they would recognize my daughter with my husband as a dependant... Any thoughts anyone? Advice? Really would appreciate it. Thank you.
