Hi there,

My husband is a US National, and has lived here in the UK for 6 years. However, he has remained on a UK Student Visa. (Tier 4)

I am going to University for the first time now (I am 24), however due to the restrictions on spousal allowance of collectively earning 18,600k p/a, my pay will drop down to 9k p/a in place of studying. My spouse will get a job which should get us close to this amount. So, we should be perfectly within that bracket.

However, my questions are:

> Will me being a student now affect the expectations of spousal support?
> Is spousal support calculated on tax year basis, i.e. if my spouse / if I lost my job, would we be given a time frame in order to get another?

I receive a bursary and other support from SAAS (Scottish Awards Agency Scotland) which allows me to study without worrying about finance as much as I would have. However, I am becoming aware that my restrictions on spousal support are really getting me down. I own my own house, and we don't need to be really earning that amount of money right now in order to sustain ourselves.

Absolutely any advice would be appreciated.

In spite of your husband being a US national, US immigration law has nothing to do with your situation.
