How is the house owned? If joint ownership, you may have to buy out his share of the house to keep it.

How long have you known he was using your SS# for his business so he could keep cheating disability? What did you do to stop him from using your SS#?

Gather up all the information you have on his business, ie. earnings, profits, etc. to present to court regarding his ability to earn money.

Who diagnosed him with depression? Will this doctor be willing to testify that your hubby is unable to competently raise your son?

The real question is not only whose name is on the house, but when was it purchased in relation to the marriage? If you owned the house prior to being married and can show that he made no financial contribution you may be okay. If the house was purchased after you married, there is no maybe about it...Illinois is a community property state and he will get a 50% share of the equity in the home. Good luck.
