What is the name of your state? New Jersey My husbands dad died in 1969 and left the house to my husband who never put the will thru probate, or put the house in his name.My husband is now ill and want to put things right. He went to a lawyer who told him he would have to pay the state taxes back to when he was left the house we have live here for over 35 years He wants to know if any one knows at what rate he would have to pay the state and we have always the taxes for the house im worried I'll lose my house

Inheritance taxes? If necessary, perhaps the estate can complete the transfer to hubby, then hubby to you and he (if that is legally where it is to go) then you and he can get a mortgage sufficient to pay the taxes.
