My father passed away 3 years ago. He owned a lot in a trailer park. I thought my aunt was the executor to his estate. However, I just found out his will was never recorded. I spoke to the county clerk's office today and was told that since I am the sole heir (and he wasn't married), I can have an Affadavit of Heirship filed which will deed the land to me. There is about $1200 in back taxes that are due. I would like to sell the land (it's not worth much). Can I make this whole process real simple by filing an Affadavit of Heirship then turning around and selling the land for a lower price as long as the new owner pays the back taxes? Or do I need to contact an attorney? I just want to get this taken care of as quickly as possible without spending a lot of money.

Also, is there a website where I can download an "Affadavit of Heirship" for free?

You need an attorney but get fee quotes from each one before you decide which one to use. One reason that the will may not have been probated is because there wasn't much of an estate.
