What is the name of your state?I live in Pa & father died in n.c. with sister as power of attorney. prior to his death she sold his home after putting it in her namee only, and also used power of attorney to change beneficaries on his life insurance policy. Father had will & testament, but nothing ever filed with court, and it names us kids as personal reps. sister refuses to answer request for estate accounting, and her husband( burke county deputy) uses his position to threaten harassment charge if i keep contacting them about fathers money. what can i do and where to go for help??? cannot afford to hire an attorney as i live on 541.00 ss disability.

Do you have a copy of the will?

Go to the probate court and file to be administrator yourself to open up the estate for probate. Then ask the judge to order sister to produce the will for court. If you can't go to North Carolina to do this, then hire a probate attorney in North Carolina to do it.

At some point sister is also going to have to be sued for abusing the power of attorney. Under normal circumstances, the law is probably written so that what she did in getting the beneficiaries' names changed to hers can be reversed.
