What is the name of your state? Massachusetts.

(In yet another lesson on saving paperwork, the forum ate my first lengthy post so now I'll write an abbreviated one).

I'm a new condo owner. (1 year)

I had to replace windows (we all did, but most did it two years ago).

The recommended contractor upped his price by $1000.00 to "bring his guys down". $3000.00 for two windows seemed extreme to me. I sought another contractor and found one through the manufacturer or the required windows.

I order over the phone (no papertrail). He comes out and measures and I reiterate requirements of make and model (just by coincidence, not knowing what was ahead).

He orders the windows before winter, and I have them replaced in March on a warm day.

Stupid me, I didn't open the one mail from the management co that said "Hey, you got the muntons (sp?) wrong. You're being fined $10/day until they're fixed". So I got $200 in fines by the time I opened it, and another $110 before the custom sashes could be ordered and installed ($150 from me and $150 from contractor to pay for 'em).

Letter also says I messed up and was supposed to tell 'em before I installed and include some paperwork. (true) I sent 'em the insurance notice and the bill of sale as required.

34 days and $340 later, I get another bill. Then the next day a letter stating the bill of sale does not denote the specifc make and model they require. They tell me to send a letter by contractor stating he installed the make and model required. I ask for it, he sends it, I pass it along.

Now they're asking for a copy of my warranty for the windows. this is not a document listed on teh requirements list. Any paperwork that came with windows I tossed. (didn't care about warranty, I planned on moving in a couple years)

Can they just fine me indefinitely? Are they allowed to fine me while I wait for their responses like that? If, in fact, the windows are wrong and I have to fight the contractor, can the just keep on fining me the whole time? These fines will make me bankrupt really quickly if I can't stop 'em. But the windows look right to me.

Also, there are other people who have not yet replaced their windows, but I believe they are not being fined at all.

Anyone? I could really use advice.

Oh, and one other question/thing-I'm-mad-about:

When they made me replace the sashes but not the whole windows, wasn't that an implied acceptance of the windows? Because if I have to replace 'em again, they basically just robbed me of the cost of those sashes (plus the time spent going through the motions meaning additional fees) for no reason.

I messed up in the beginning by not notifying them and sending the paperwork, but that was dealt with.

I have to eat $300+ in fines while waiting for them to respond to that?

And again, they told me to replace the sashes, which I did according to their requirements. And yet they're still fining me.
