"Within 100 Feet"

What is the name of your state (only U.S. law)? Florida

In the former wife's injunction for protection it states:

* during exchanges of the children I may park within 100 feet of her but am not allowed to exit my vehicle

*during school functions I am allowed within 100 feet of her but am not to have direct contact

As I understand it, this means that I may stay a reasonable distance from her, less than 100 feet, so long as I do not make direct contact with her or exit my vehicle (which ever is appropriate for the situation).

At our exchanges at the local police department, I generally park several spaces from her so that our children are not being forced to walk unattended through the busy parking lot. I have not exited my vehicle during any of these exchanges. At the school functions it is impossible for me to sit 100 feet from her due to the small size of the cafeteria where these events take place. I generally will sit as far from her as possible and do not make any contact with her whatsoever.

She has recently filed a motion for contempt stating, in part:

"On several occasions the respondent has either parked less than 100 feet from me during the children exchange and has sat within 20 feet of me at school functions.

The respondent needs to respect and abide by the injunction for protection and have a clearer understanding of within 100 feet."

Am I in violation or is she just nit-picking? Perhaps I should take a queue from The Simpsons and begin carrying a pole that is 100 feet long just to be safe. :rolleyes:

If what you wrote is the EXACT wording of the injunction, then you are not in violation unless you make contact with her. Tell her to pound sand.

The petitioner obviously needs a clearer understanding of
* during exchanges of the children I may park within 100 feet of her but am not allowed to exit my vehicle

*during school functions I am allowed within 100 feet of her but am not to have direct contact

And again request the motion be dismissed as frivolous .

Each and every time the X files petitions that are clearly frivolous , answer back that they be dismissed as they are frivolous .

Where appropriate have them dismissed with prejudice , and santions for filing frivolously .

I know but I can't resist. But how do you propose he do this without having contact. Would carrying a sign matter:D
