You just can't "not pay" rent as a matter of fact, if you need to be current on your rent to avail yourself of all the redress I'm about to describe.

If there are legitimate code violations, you need to notify the landlord in writing. After 30 days, you can go to the clerk of the court and start depositing your rent with the court rather than sending it to the landlord. The landlord them can either challenge your assertions or show he as fixed them to get the money back.
