My ex-husband refuses to take our children to physicians under the insurance plan. Unfortunately, I am responsible for both the monthly premiums and 50% of the balance not paid by insurance. Today I received bills for $1,500 in surprise mental health treatment for our son (we have joint legal custody so this treatment should not have been a surprise). The provider is not in the plan nor did my ex attempt to find someone who was. I am expected to pay one-half this cost. It has been my ex's practice to withhold any funds he deems he is due (medical bills, shoes for the kids, etc.)from child support.

The Final Order does not address this issue regarding insurance and retaining providers covered under the plan, just that I will provide it, we should discuss issues concerning affecting the health, etc. of the kids, and that we are each responsible 50/50 for medical expenses not covered by insurance. Any ideas how to handle? Is there case law in Georgia that addresses this issue?

Does he pay the child support directly to you or does he go through a CS agency? If he goes through the agency any deductions he make will be showing as arrearages and eventually he will have to pay them. You are going to need to take it back to court to get him ordered to use doctors that are on your insurance plan....or to otherwise be 100% responsible for the cost.
