What is the name of your state? IN

My wife is currently working as an Activity Director with a local assisted living facility. Part of her job is to create a monthly newsletter. Although the company does have a computer, they have told her that they will not purchase a program that is for such purposes due to their computers' age/speed. Also, they made it known they have no plans in updating it. She was told she would have to use her own computer at home and also that she would not be paid for the time it takes to create the newsletter.

If doing required work for a company, aren't they required to pay you for it?

Whether they have to pay her for the time spent creating the newsletter depends on whether she is an exempt or non-exempt employee. Is your wife paid on an HOURLY basis? If yes, then they must pay her for the time she spends on the newsletter.

If she's paid on a salaried basis (i.e. a fixed weekly salary regardless of the number of hours she works) then she need not be paid for the additional time, assuming her job is properly classifed as exempt to begin with.

If she objects to this unpaid 'intrusion', then simply tell her to type it up at work. Seems pretty simple to me.
Or is it more likely that she CHOOSES to use her computer..... and HER software instead???
