World Series 2002 Ticket Snafu

Here is a seasonal problem. Unfortunately, we (my partner and I in this baseball mini-game plan) are being made to be the dummies...

During this years baseball season, my friend and I purchased a 10 game mini plan with the Anaheim Angels. At the time, we were told by the salesman, and it is documented in their literature, that we would be given advanced notice and option to purchase any post season tickets ahead of the general public. This was one of the major reasons we decided to go ahead and get the plan. Over the last 5 years since moving here, we have purchased tickets at the box office at full face value for an average of 30-45 games per year...

Well, as the country must know by now, Anaheim is in the World Series starting this Saturday. To bring some up to speed that may be able to give sound advice, there is a division playoff series, a leage series (ALCS for us) and then the World Series. We were led to believe by the Angels & Disney that we would get "ADVANCE NOTICE" and opportunity to purchase. For the first post season round, we never got any notice. We feel it was up to them to fulfill their promise to contact us. We got a call 4 hours before the advanced sale was to end telling us we had 4 hours to get our money in because our notice was returned undeliverable. We missed that 4 hr window because we were out and it was left on our voice mail. I found it hard to believe they mailed notice that late that it only came back and they only had 4 hours to notify us of this? We called our actual representative and he quoted back to us the correct address on file... they made no offer to help us. We bought tickets along with the general public.

As the team advanced to to the A.L. Championship series, we never receieved any notice again as to when our pre-sale tickets were available...and we lost out big time. Neither of us were in a position to brave the phones or crowds due to work and other commitments to get tickets and we never got to obtain tickets.

Lastly, we figured they would give good notice for the World Series (those tickets usually go on sale if it 'appears' the team is going to make it to the next round). Well, by the time they announced the date for World Series tickets for public sale, the pre-sale for game plan holders was over. Again they failed to notify us of the date we could call for plan holder/early bird sales.

My partner in this called our rep and he basically told us it was our fault for not calling him to check. We don't have all day to call and check-I have to work and my partner in this is terminally ill and testing for a dual organ transplant! They were supposed to send us notice or call us. My partner called and asked if there were any tickets left after the public sale had officially sold out. Of course he was told no. Now, where I work, our operations manager knows people that work for the Angels. He came in Tuesday (3 days after sell out) and announced his friend at the Angels was getting him more tickets that day. Why were we told that there were none available and why couldnt they honor our contract and sell us our 2 tickets? Again, it was all 'our' fault. Even today, 2 days further, it was announced a limited amount of tickets became available. There were many tickets still available, and despite their having dropped the ball, told us 'sorry, sold out'.

I have no idea what 'restitution' would be available. We're out seeing the series, but no money was actually lost. What can be done? Disney is usually very consumer conscious and works very hard to rectify problems, but this was awful. Are they liable for anything to us? Did they fail to keep any part of the agreement in our purchasing this plan with these guarantees?
