What is the name of your state (only U.S. law)? CA
A family member is having some real hassles with the estate of her parents. The estate primarily consists of a home. The home is currently vacant and in need of improvements/minor remodeling before it can even be considered sellable. Her brother was named executor and is not cooperating or handling the estate at all. Credit card companies and other companies with unpaid bills are not even aware of the passing of the testator. The money that was left in a savings account has been used by the executor in frivilous ways. $2000 was paid to a friend of the executor for exterior "painting" of the house...the house was never painted, for 6 months now, the exterior has been left with "stucco" splattered on all the walls visible from all angles making the house look so downtrodden and slumy. The executor has refused to hire anyone else to actually do the job even though the estate has money for it...the exterior wood has been left bare and is now ruined due to the elements and winter. The executor also hired a company to install carpets in some of the bedrooms which was completed pretty well. The executor then proceeded to not pay them the $5000 owed them despite the estate having the funds available. If that wasn't enough, it was discovered that executor racked up thousands of dollars in debt in the testator's name without their knowledge.
I know, with common sense, it seems that there is no way an executor would NOT be removed in these circumstances. Though I've come to find that common sense and the law don't see eye to eye in many cases, so can anyone give me an idea if these are all strong enough legal grounds to make sure the executor is removed?What is the name of your state (only U.S. law)?
