I was found guilty of a traffic violation for an unsafe turning manuver. I believed I was being ticked (on 11/27/99) for turning right at a stop sign at the top of an off-ramp of I-80 (rather than curving to the right and yielding). In court, the officer, under oath, said he ticketed me for making a u-turn on a freeway on-ramp! I was never near an on-ramp, nor did I know one existed at that cross-road. The commissioner said he 'must rely upon the integrity of the officer' and found me guilty. I wrote to my Govenor, State Assemblywoman, Senator, and the Highway Patrol. I was told that all I could do was file a citizens' complaint (which I did) but then was told by my representatives that I could also appeal. I have done so. Now, I am told that I may file a form to SUSPEND ACTION in this case pending the investigation of the officer. Can you tell me what the form is called so that I may file it before August 22nd...the day I must have completed my traffic school to keep the citation off my record? P.S. When I posted bond in December, 1999, I asked for a court trial. My case was incorrectly closed by the traffic division and re-opened in February when I went to inquire as to my court date. I was given a May 22nd court date (not a timely trial). Additionally, since I have until 8/22 to complete traffic school before this infraction goes on my record, I found that Traffic Division had posted it against my license incorrectly when I got a notice from my insurance company. Guess who is investigating the officer...the California Highway Patrol!
