About 6 months ago, my insurance company took my drug store off of the provider list. In the process of changing pharmacies, my blood pressure and stomach medicines were doubled in dosage amounts. I have experienced many of the side effects associated with overdosage. I won't get into the details here. I just wonder if I have any legal recourse at all, and how should I proceed? Thank you for your expedient response to this question.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

I am unsure as to how the store change and doubling of dosage are connected.

But if somehow the pharmacy (new one) was doubling your presecription, THEY committed malpractice, not your insurance carrier. The only way your insurance carrier would carry responsibility is if they knew of this pharmacy's track record. The principal agent theory may work in this case if insurance companies are generally held liable for the providers on their list.

Contact your state insurance commissioner and see if that office can help you. If they think you have a case, you should consider seeking a medical malpractice attorney (www.attorneypages.com)
