So, I have to be a bearer of good news- a rare for our forum! This week, we went to mediation over custody in the middle of a nasty battle. The mediator was so disgusted with my husband's ex-wife's behavior, her screaming, her irrationality that he cut her off and strictly spoke with my husband to make a gameplan.

Mediation rarely works, especially when both parties are fighting for full custody, however, it was affirming that the mediator (also an attorney) told us that he had full faith that our children would be moving in as soon as trial ends! Of course, no agreement was reached, and the ex stormed out of mediation before it ended (big NO NO). So, to bear good news, things are going well on SOMEONE'S front!

In Texas, walking out on mediation will never get told to a judge. What goes on in mediation is not admissable in the courtroom and it does not sound like your mediator actually mediated anything but controlled the situation to your end. Not good :(

Karen has a GAL been appointed? If not, be sure to request one! Unless your ex miraculous changes his attitude, it will shine through in court. Glad to hear you're in high spirits, but don’t breath easy just yet, stay on your toes. :D

If that's true, why bother having mediation at all? Besides, it will get before the judge if "Karen" states it during her time to present her case. Lawyers do it all the time (some get reprimanded, most don't), so why couldn't a plaintiff?

Anyway...it does go to show that given enough rope, most idiots will hang themselves. It sounds like the ex lacks self control (although it is easy to become emotional with some of the ridiculous decisions I've seen and heard in family courts). Obviously, we don't know all the issues, but if you truly are a better parent and love these children as your own, then I wish you luck.

What about shared custody? That can eliminate a lot of the fear and animosity that always makes 100%/0% custody a real danger.
