How do I go about getting a passport for my children if my soon to be ex-husband won't sign the consent? We both have family over seas which I visit my family at least once a year or so and he can't travel over seas at all due to his immigration status but he refuses to sign the consent knowing that I will never take a trip over seas without my kids if I did I won't have anyone to stay with them not even he would stay will them until i return??

Doesn't dad have times of possession of the children? Can't you plan your travel while dad has the kids?

Is the country to which you wish to travel a swignatory to the Hague Conention?

You can ask the court for an order giving you consent to get a passport and/or ask the court to order him to sign the consent or face being cited for contempt (which could include jail). I have seen judges do both.

Their father has visitation everyother weekend which he doesn't excercise so I can't even take a trip when he has them, so i guess I have to get a court order. He states no court can get him to sign the paper so deal with it. He is just being vindictive and wants me not to go anywhere eventhough we are not together anymore.

You take it back to court and ask the judge to order him to sign the passport applications.

If the coutry to which you are travelling does NOT enforce court custody orders from the US, then do not be surprised if the judge is not comfortable with ordering your ex to sign for a passport.

Of course, if the ARE Hague convention signatories, and DO have agood record oof enforcement, them there is no good reason to NOT authorize the travel/passport.
