Mothers Visitation Variance

What is the name of your state? Texas

I received custody of my daughter last April from her mother who resided in NH and was a confessed crack and heroin addict. At the time my ex lived with her mother in NH. Because she lived with her mother the court put the stipulation upon the order that my daughter can visit 3 times a year for a total amount of five weeks but only under the direct observation of her mother. My ex was told in the court documents that at no time is she to be alone with my daughter. My ex has in the last 2 months moved to Georgia and is now requesting to pick up my daughter via plane herself and keep her in Georgia under no observation. The court order says that if I agree my ex can have her alone. I have told her no because my daughter has only lived here for nine months and with my ex having no rehabilitation I don't feel I can trust her with my daughter. My question is since my daughters mom claims to be clean and has lived out of NH for two months do I allow my daughter to go to her mothers unsupervised or do I just allow her to pick her up via plane if her mother agrees to be in Georgia when she gets there?
Also I think that she might have a warrant in NH because she really does not want to go back there.

Tell the ex if she can afford a plane ticket then get her butt to Texas where you will supervise her visitation.

No way would I agree to allowing her to take the kid on her own. Not even on the plain to fly to NH.

This is actually real good advice BB. And it's also the most practle too.



Let's see, where was the CO made, in NH or in TX? This could be a case that if you have the cash to spend, go back to court and mod your CO to include court mandated drug testing prior to executing unsupervised visitations.
