I lost my job two months ago and moved back to the LA area. The LA county child support division has been a nightmare to deal with and they are currently stating that I owe them back child support of approximately $10K. This is inaccurate and I am about to conduct yet another full audit with them to prove that they have made another mistake. The most I owe is about one and a half month of support.
The only thing that I have left is what little I was able to save through my company's 401K plan before I left. I want to liquidate this money (will pay 20% penalty) so that I can continue to pay my expenses while looking for a job. The county has not placed a levy on this account (yet), but they had placed one on my bank account.
Do I increase my chances of having this money levied and taken away from me once I place an order to liquidate the stocks and cash out the proceeds? Will the bank that manages this account first check with the Franchise State Tax Board, or Child support agencies before cutting me a check?
