What is the name of your state? new york state


my friend has been in the United states for almost 2 years now. she came to New York from the Phillipines for school. she graduated recently and student visa is about to expire at the end of this month. is there anyway for her to prolong her stay for about 6 more months? i have no experience with student visas and how they work so any little advice would help.

she was trying to get a job which would gladly sponsor her but she said she doesn't have the time to do the paperwork at the moment.

Depending on the type of job she would be offered and the type of employer, she might be able to change status to an employment-based, allowing her to stay and work. If she does not have immediate job prospects or would not qualify for this type of visa, she can try to change to a visitor's status and if it is approved, she can remain in the US.

what would she have to do to remain here as she waits for the application process? because her visa expires the first week of december and i know the application process takes longer than that. is there some way to obtain an extension while waiting for the processing of paperwork?

Well she doesn't sound very motivated if she can't make the time for the required paperwork. ... are you sure she wants to stay?

Visa expiring means nothing. What matters is the I-94 and if it is D/S (duration of stay) then there is no definite expiration date. Typically, even if there is a definite expiration date, as long as a petition is timely filed (before the expiration date) the person can remain in the US while the petition is pending.
