Im just going to quickly explain my situation. I have ADHD and I received a D in a biology class taught by an instructor from another country. English isn't his first language and it was very difficult to understand him. Even when i, or other students, asked questions in class, his answer was usually off on a tangent, we would look around at each other realizing that his lack of knowledge in english prevented him from understanding. I am wondering if I have a case, im not necessarily seeking money, but maybe a better grade. I do believe I have suffered damages from it because it may cause me to lose my scholarship.

I guess my question is whether or not I have a legal case and what type of case it is.

Based solely on your post, you have no case.

Your disability needs to be recognized and certified by the school. You cannot now request accommodation for a completed class.

Professors often go on tangents. If you miss something or have difficulty understanding the professor, it is your responsiblity to find out what you missed or request accommodation through the school's ADA/Disability coordinator before or immediately after the semester begins. You are not in high school anymore.

I would begin with meeting with the professor during office hours. I would also seek a tutor.

That is a real stretch to be claiming ADHD as a reason for your poor performance. If the prof was not qualified he would not be teaching there and I am assuming that the entire class do not fail.

If you had issues with the class you should have dropped it or taken corrective action at the time but not after the fact. Certainly you knew you were failing and hopefully don't think your disability entitles you to a better grade. If you push this issue on your disability basis I think they will rightfully show you the exit.
