Yup- I prevailed after all! The calculator says support should be $109 a month, and the judge awarded me $500 per month. Basically he imputed an income to my ex based on a percentage of what he was capable of earning, based on a job he held back in 2002. The judge said that my ex could work a part time job to put himself back up to a salary closer to what he earned in 2002. Right now he earns 30k per year. In 2002 he was earning 42k per year. So the judge upped my child support. So I guess now my ex will have to either get a part time job to make ends meet, or cash those inheritance checks after all.

Which leads me to my next question... if he is getting 14k per year through income generated by the land he inherited, that puts his salary up to about 44k per year. If support is already calculated based on an IMPUTED income (the judge didn't use the term "impute" but implied that that was why he was upward deviating) am I allowed to go back and have support reviewed to include his income from the farmland?

Meaning... he makes 30k. Support was based on a higher income. He will get about 14k per year in income from the land. If I go for a review to get some of that farm income, does he have a cushion?

Of course, all of you claimed I would lose before, so what you say now is probably just speculation. I will say it again...

I guess when I say he "upped" my CS that is not what I really meant... what I MEAN is that my ex was trying to get it lowered to $110 a month, and the judge ordered it to be $500. He is currently paying $730 per month. So I got more than my ex and the CS calculator was stating. Sorry for the confusion.

Yes, my mother did pass away, in December.
I had concerns that I would find the same legal forum she posted on- she had told me last summer that she had been getting legal advice online, but in the few times I had been on here, never saw anything that stood out as her. So I thought she must be on another site. But I was only searching the Usernames, not posts. When I decided to post here yesterday, I thought changing some of the "revealing" facts, like amounts and such, would keep me annonymous if she found me.

Gah, that can make things more difficult, since the numbers and dates in Left Out's postings don't jive with yours. But I'm not good at picking up on things like that, I have a tendency to take things at face value, and I can't read people very well. (The only reason I can play poker with any skill at all is I can crunch the math.)

But, that being said, if this is the first modification since the new (TN) guidelines were implemented, the judge can split the difference (equitably, but that doesn't mean equal, and the judges can have wide discretion on what actually is equitable) between what you were previously assessed (and paying, good for you!) and what the calculator says. (As per some digging up on Google I did. Found the information on a Memphis attorney's website.)

On the other paw, file for modification as soon as the guidelines will let you, and you should (I think) then be at the guidelines.


Guess that didn't work... she sent me an email yesterday saying she saw my posts and knows it's me and that I'm "stalking her". ????

Tell her to pound sand.

They obviously prove she is out for $$$ and very apparent to keep the kids away from him.

If I was an attorney in his state, I would LOVE to take his case pro-bono simply for the satisfaction of squishing her like a bug. Of course, he needs to bring a can of Raid for her as a present and give it to her in court!!!! *evil laugh*

As she isn't posting under her real name, and is also apparently giving out false identifying info, he would have a very hard time proving the posts originated with her.

Even if he can't authenticate her statements, he can certainly use the insights gained from reading them to help himself and his attorney formulate a strategy to attack her weaknesses on the stand.

I agree for the reasons bolded above. Also, that sinks her 'stalking' allegation...SHE sought out/contacted HIM on this site, not vice-versa. :cool:
