I would probably wait 4-6 months before going back to court. I'm thinking status quo on this one. If the children are with you for an extended amount of time, she won't have much leverage when she tries to counter for custody.
I would ask for full-time income to be imputed for mom.
Then get her for contempt if she isn't paying.
Thanks Ginny J - I do appreciate you taking the time out to reply. Have been trying to get some direction on this for a while. I'll keep things as is until around next May or June to file. By then her child will be 2 years old and our children will have been with me for about 7 months or so. Hopefully, keeping my fingers crossed, by that time the court will see things differently and impute a full time income on my ex so that our children can be supported equally by both parents. In the mean time I will keep papers and records of the daycare bills so if they are not being shared equally I can also file for contempt.
Last question for you - Currently we claim one child each for income tax purposes. Now with her moving away and me taking on majority custody (about 75%) does it give me any leeway to also file to claim both children at the same time? TIA
