OnGoing Saga Sorry Update?

What is the name of your state (only U.S. law)? Div in NJ Live in NC

The saga goes on, I have been waiting for about a month and a half now for wage garnishment from Ex. owes twenty thousand. Has warrants but can't be found.
OK talked with CSE today and they know who she gets paid from a third part payroll service in Fla. she has waited the 30 days and then sent out enother letter. It was returned saying Fla. will not or doesn't follow out of state garnishments orders and it stated she (CSE) must get a Fla. court order. Am I now to go to Fla. and get an order just because the payroll co. is there ?
Sound kind of dumb to me I doubt the CSE is going to file an order in Fla. She told me this was the first time they have come accross such a thing and they will have to investigate. She'll probably quit by then.

Whoever said that is either crazy, or just doesn't know the law. Florida can, and should garnish pay. I don't have time right now to find the exact statute, but go to Statutes & Constitution :View Statutes : flsenate.gov and read through 61.1301 and chapter 88.

The only thing is she's not a Fla. resident or even live in or work in Fla.
She lives and works in NJ. The payroll co. is in Fla. only they won't even give CSE her home address or who she even works for. I was told this at 8:30 am yesterday by CSE.

The third party payroll service cannot guarnish accept a garnishment against her wages, only her employer can do that. That is why they are saying that they need a FL court order. Not to guarnish the wages but to release the information about her and her employer.

One problem is they can't find where she works her SS# for the Employment line in NJ the way they get their information shows the company in Fla. is paying her, but that's not her employer.
What are the chances of a CSE agency doing that or is it on me or can I even do this on my own ?

Up Date Help Sorry Update !!

Ok last month received half my Ex. Wife's stimulus check Ok. This week received her income tax, pretty good because there's always a catch, she's a con artist.

Today get a call and the CSE the IRS wants them all back (fraud). I spent the money on the kids and paid off bills. This check was deposited in my sons bank and withdrawn.
What will they do to my son since it was deposited in his account ?
Why don't they go after her ?

You are saying that the IRS called you and asked for the money back? The IRS doesn't make phone calls like that. In fact, the IRS doesn't even know the name of the individual who ultimately receives the money.

It goes to the state, and the state disburses it. Now, if it was the state that called you, that is still a little usual that they would call rather than sending a letter, but they will collect it back from you, one way or another, if the IRS takes it back from them.

Got the call from ______ ______ . Yes it was a leginamte call I have delt with him before. He heads the Tax intercept program in the county where CS is.

Just a thought, maybe she is a LEASED or TEMP or CONTRACT employee? OR It's a Joint Venture company with many subsidiary, and they use a "payroll company" I use to be a leased employee for 10yo and no one ever understood it. W-2 said one thing and all my other employment info said another, on top of the fact the actually company I worked for had 3 NAMES in 3 Diff STATES and I got paid from another state that was not even one of those. It was so confusing to others. (So glad I don't work for them anymore!)

Ok talked with CSE many times over last several weeks. Conclusion is that after several attempts to garnish her wages thru Payroll co. in Fla. they have given up. The Garnishment has been purged from the the NJ CSE computer. I was told they haven't responded to the last two request. She does work in NJ and they know where.

Isn't the Co. she works for responsible for the Garnishment and not the Payroll Co. ?

Isn't there any legal consequences for the NJ Co. she works for not following the court order ?
