I was recently wrongfully terminated from a Federal Agency. I filed a disability discrimination suit with the Agency.
I was recently called to say the Agency wants to settle with me. Besides getting my job back, I want to be compensated for my financial losses.
Can you direct me to a site that would offer guidance on calculating a compensation award for mitigation?

Compensation Mitigation

How much in wages would you have earned during this period?

Approximately $18,000. + I had to move to the location, leaving my wife and family behind until we sold the home. Fortunately we had not sold it yet.

I would like to include punitive damages because of the unnecessary stress and damage to my health from being seperated in such a way.

I also have 3 instances where two of my supervisors lied, 2 on record.

I want to be objective, there is a lot of emotion.

Did you file a formal complaint with the Agency, or a lawsuit in Federal Court?

Have a consultation with an attorney who is experienced in federal employment law cases. Explain your situation in advance and ask him or her to help you evaluate your damages and a reasonable settlement amount. Once you have agreed to a settlement, go back and have the lawyer review the proposed settlement agreement and advise you about what it means.

This is not a "free consultation" situation. You will pay by the hour for the attorney's time to perform these legal services. It will be worth it. The atorney may offer to help you negotiate for a contingent fee (percentage of the settlement). If you do that, make sure that the agreement with the attorney is that he or she only collects fees on any amount you receive that is in excess of the amount that has already been offered to you.

Compensation

Thank you for that information. I filed with the agency, and am now in the 180 day period for the agency to make a determination. Depending on their decision to Accept/Decline the claim will determine whether or not I file an appeal with the EEOC.

However, I was contacted by someone within the agency Friday to say that a representative is interested in some form of mitigation, possibly to include my job back as well.
Could disability discrimination cases include punitive damages besides monetary reimbursement for losses?:rolleyes:

Are you serious? Can you explain where you came up with that number, or was it off the top of your head. If I was to use that number, I would like to be able to provide some form of understanding as to how I came up with that number.

I am not sure where the misunderstanding has come from. If you read my first post, I am clearly asking for information about a website that could assist me. I would not be so foolish as to hope or expect that someone could give me that detailed information either.

I was hoping there was a website that could offer resourceful information such as this. Perhaps through the Government, or privately.

you said you wanted to be compensated for your losses. add up your losses and ask for that.

Well Veronica, obviously you did not read my original post. I was looking for a site. I was not, I repeat was not looking for trite responses to my questions. I was not looking for advice, only sources of information.
