Grandparent Rights ... (couldn't find using search feature)

To clear up a few things ...

Dad has sole temporary legal, and sole temporary physical custody of the three children, there are two review hearing dates ... one in 6 months, and one in a year.

Mom has supervised visits at a supervision center that does not allow "guests", so grandma cannot visit with mom. Ideally they would LOVE to be able to visit the children together but it's simply not an option at this time.

MGM sees kids at Dad's home now, and is very uncomfortable for her there. Stepmom seems to pride herself on making MGM and Children cry on a regular basis.

MGM just wants a court order allowing visitation. She's not seeking any type of full or even partial custody, She just wants visitation.

My question was answered right away. I guess I missed the "grandparents rights" forum, and for that I feel stupid, and apologize, I should've expanded my search.

Either way at this point grandma has no legal rights to the child. Grandma raised mom yet mom can only have supervised visits...... So why should grandma have a say in the life of another child?

So how abusive was your girlfriend to her child? How long has CSB in the case? Has girlfriend completed the caseplan? Quite frankly, grandma doesn't have a chance. Especially since she is allowed visits but just doesn't want to exercise them because she feels "uncomfortable".

Grandma does still exercise her visitation even though she's uncomfortable, she was hoping for some relief from that uncomfortably.

Mom wasn't abusive towards the kids. Her issue was neglect due to alcohol usage. She demonstrated that she is alcohol free (and all other chemical free through the random U/A screening) It took her a long time to admit that it was an alcohol problem, and not just a "sleeping problem" as she'd originally tried to claim.

Social Services was involved for only 6 months. It stemmed from an incident where she had been awake all night, she "drank to fall asleep" only it was at 6am when she was drinking, and she was home alone with the kids. She fell asleep at 7, kids got out of the house. Now that she's alcohol free, she's a completely different person. Who she is now, is not who she was back then. When Mom was involved with 'Carver County Community Social Services" CCCSS saw fit for Grandma to be the "supervisor" for the visitation.

The Guardian Ad Litem never put together an official report, and the Custody Evaluator said "The children could be at risk in either home" ... and they both recommended not changing anything and continuing the case for an additional year so they can do some more investigation stating things about how they didn't have enough time to do a proper investigation.

I could sit here and talk all sorts of crap about her ex, it'd be far too easy, because he's making it easy ... That's coming from the school who's noticed poor hygiene in the children, weight loss in the children, general withdrawal, and hyper-nervousness.

It's been a difficult battle. I've known both Mom and Dad for the past 2 years, I've watched Dad be absent from the home, and buy Mom bottle after bottle every time she'd complain about dad never

I suppose all I can do is let Grandma know that she can try filing, but the general idea is that no one thinks she'll get visits, because technically she has no rights over the children. I must admit it's not happy to hear that news, but I'd much rather hear bad news, than having people telling me just what I want to hear.

So the county case is still open?
 
Social Services closed their case.

Ramsey County Family Court made no determination about custody, only allowed dad to continue sole TEMPORARY legal/physical custody of children. Mom continues supervised visits for 3 months at which time the level of supervision will be a step lower. She'll continue that for 3 months and then she'll get 8 hours with the children off-site, and after 3 months of that she'll get full weekends, from Friday evening, until Monday morning.

She's not exactly happy with how long this is all supposed to take, but the more she does things the right way, the better she's going to look in the eyes of the court.

Based on that timeline I would not suggest that grandma file for visitation. Within six months mom will be having unsupervised visitation and grandma will be able to see the children on mom's time. A GPV case could easily take far longer than six months.
