I had bought a car from a dealer only to discover that the car had a lot of issues. I bought the car with a 50% warranty coverage on it. When I took it back to the dealership, the dealer didn't seem to know how to fix it. Yet he had passed its inspection. Well he then suggested to "purchase" the car back from me, well I had only had the car for three days andI hadn't even registered it, let alone pay the taxes on it. I had bought it for $5500.00. He suggested buying it for only $4500.00. I knew I was scammed since he knew something was wrong with it in the first place. And upon my investigation it seemed like someone had returned it prior to me purchasing it. Yes the car was advertised on line and it seems like he is doing this over and over since I have seen the same car back on line for sale. Well I have since filed a small claims lawsuit. I just need advice what I need to tell the judge since I understand this dealer has some powerful attorneys on his sideWhat is the name of your state (only U.S. law)?

so, you bought the car used? as is?

when you had your mechanic look over the vehicle before purchase, what did the mechanic say?

I took the car to auto zone for a diagnostics and they stated it had to go back to the dealer. the car was not as is, it had a 50 % warranty, meaning if there was a problem we would split the total cost. And the funny thing was he took the car back and refunded me less money. Yes I understand he could have charged me something but $1000.00 for three days??? thats why I filed the suit

Currently, you have no damages. You have to get a quote on the cost to repair the car.

Then, you have to look at the economic side: If it costs $3,000 to repair the car, then you're better off returning the car and taking the $1,000 hit since you'll have to pay $1,500 (50% of the $3,000) for the repair.

You do NOT have the option of returning the vehicle and you're going to get smacked down in court...

he already took the car back and gave me $4500.00 I was under durress and I needed a safe vehicle for my children and I so I had to go buy another vehicle. I needed safe transportation, he aleady has the car and the 1000.00 thats why I'm suing. He never offered to fix it since he knew it couldn't be fixed. The problem had to do with the braking system and according to autozone the car had to go back to the manufacturer, which happened to be mitsubishi. The dealer is just a street side dealer, he had his mechanic look at it then he suggested I take another car, well all the other cars he had at the lot had prior accidents according to carfax and were way below what he was asking for. The fact was the car ownership was never transfered it was still his car since for me to have sold it back to him I would hava had to pay the taxes on it and registered it then brought it back to him to sell it back to him. The sale was voided
