Hi,

I live in NW Illinois and I own a condo. I have moved out from there but still own my Condo and I have plans to rent it. I finally found a tenant, but I wanted to keep the basement and only rent the first floor, so that I can stay in the basement when I go there 4 days a month. But, my Condo association members have brought up that it is a single family dwelling and not two families.

I really am not living there and I have my own apartment in Chicago area, so I told them that I come there and stay only for 4 days. They are planning to bring this issue in the board meeting. They say that two families cannot live and it is a single family dwelling. What if I have 10 people in my Condo who are not my family members and it can be my friends? All, that I am trying to tell them is that I stay there just 4 days in a month and that is due to reason that my children live there and I go to visit them every other weekend.

This is my condo, I have bought it paying a price and I pay my mortgages and top of that the association has the things to dictate what I can do and cannot do inside the condo? I think in the future, I have to ask the condo association permission to sleep with my wife also... This is ridiculous. Help me with your expert advice please. I am really pissed off and I am trying to make ends meet and finally found a tenant who would occupy only the first floor and here I am again back to the square one with the board members.

Unless your CC and R's state otherwise- and the city has no problem-you should be fine. However if the CC and R's/City are not- then you must comply with the most restrictive legal rule.
 
The answer is to be found in the Declarations, By-laws, and Rules. FYI .. the Board of the Association can tell you what colour the window blinds must be; the "but I own it" line just doesn't fly.
