you dont get checks back anymore .. only crappy photocopies & they destroy to originals .... maybe your bank can get the info though ... I would go over to the guy with a couple of my boys and get the 5K ...

Wrong again. Not only wrong but dangerous and absurd.

OP, Wrong is dead wrong ~ You can get your checks back if they are still available since not all banks are image capable yet. In the event the original is not available and substitute check will be made available and must be made available upon request.

i tried to look at my checks that i wrote him last year, but he cashed them at my bank... he also used a non drivers military id.

no, i dont believe he is in the military any longer.

i signed the information subpoena yesterday, and the judge was mailing it as i was leaving the court. so we will see if he even bothers to fill it out... probably not

Because this is way way it works .

1. Information Subpoenas
If a Small Claims judgment has been entered in your favor, you may obtain an information subpoena from the Small Claims clerk upon payment of a $xx.xx fee. If you request it, the clerk will assist you in the preparation and use of the information subpoena forms. Some stationery stores also sell information subpoena forms.
An information subpoena is a legal document that may help you to discover the location of assets of the judgment debtor (defendant). It is a legal direction to a person or institution to answer certain questions about where the assets of the defendant are located. The information subpoena may be served upon the judgment debtor and upon any person or corporation that you believe has knowledge of the judgment debtor's assets -- for example, the telephone company, landlord, or bank. Separate forms are used for service on the judgment debtor and service on any other person or corporation.
The person or corporation served with an information subpoena must answer the questions served with the subpoena within seven days of receipt. The information subpoena, accompanied by two copies of a set of written questions and a prepaid addressed return envelope, may be served by ordinary or by certified mail, return receipt requested

You would be provided directions on how to serve these.

right, i was simply implying that the defendant will probably not fill out the subpoena. since he hasn't bothered to answer anything thus far.

the judge had everything ready for me when i arrived at the court yesterday, and just needed my signature before he could sent it out

Do not they have a clerk there ?

Well, if i am following history, i am not expecting him to answer the subpoena.

so, i guess its off to the next step... which i believe is to file and "order to show cause"?

or am i missing something else.

again, thanks for all the advice from this forum!! im very greatful to have found this.

as expected, its been past the 7 days now... and nothing.

i guess im stumped on the next step. any help would be greatly appreciated.
