Our negligent Landlord is putting our life at risk on daily basis

We noticed last year, there were wasps & other types of flying insects making nests right over the doors of our rental home. We don't own the home, but we've been stung before we moved there by flying insects, and had to be rushed to a medical center to be treated, b/c I because I had an anaphylactic reaction. Trouble breathing, rapid heartbeat, just not feeling right at all.
The doctor gave us some kind of medication, at the time, don't remember what it was, but they were also so concerned for our safety, they prescribed us a injection you have to give yourself.
We didn't get the injection, because that landlord at the time, refused to tell us they were raising the rent to over $200, they just told us on the phone we'd be paying $75 more. We had to move out in 3 weeks or pay an additional $225 for rent.
That's another lawsuit, waiting to happen, but we moved out of that place, and didn't think we'd need to buy the injection, for the landlord where we moved into now, provided us with a certificate of Occupancy, meaning the house, I presumed, was safe to live in.
After we moved there, though, we found out many things that were simply not safe in the rental house. The landlord, in fact, didn't bother to allow us to move in on the date the lease started, because they were on a family vacation!
Now, we have hornets making nests in the attic of that same rental house. Before I called the landlord, knowing how allergic I am to wasps/hornets and these type of insects, I called an exterminator.
The exterminator came out immediately and told us we had both hornets nests & wasps nests making nests over various door of the house! How creepy & dangerous this is to deal with if you are deathly allergic to these insects!

And our stress level is so high, now we have high blood pressure many times, when we check it. Never had high blood pressure before, it was always very low & safe.
When we called the landlord, he told us that "Oh, I wish you didn't call an exterminator", though the exterminator didn't charge us anything for the visit.
In fact, it would cost only $85 to get exterminator back out there and fix the dangerous problem.
What the landlord did instead was just leave an aerosol can of Wasp spray on the back steps, and it was sitting in the hot sun, to boot! well, aerosol cans can explode if you leave them in the sun. We could have opened the door to that steps, and had it explode in our face!
And even though, we wrote him a letter, and he received it, and it stated in the letter, that we were allergic to hornets & wasps, he actually expected me, the one who was allergic to these dangerous insects, to spray these wasps myself!:eek:

I had a gut feelling that would put our life on the line, i.e. we'd die, and I didn't do it... but the landlord, said he's hire an exterminator but he's yet to do so.
All we have to protect ourselves now, is a wasp catcher, and that's no guarantee the catcher will catch all the wasps/hornets, for now they've drilled holes in the foam insulation he insisted on spray in the cracks of the house, where the wasps were flying into! We've even seen the wasps drilling through those holes, so I know for a fact, they've probably got a nest up in the attic!
I'm scared to death. He's refused to do anything about many dangerous situations in this house. Even back in early November, we noticed there was about 20 wasps that had gotten caught in the wasp catcher, that was the only thing he did to try keep us safe, was reimburse us for a wasp catcher!
Finally about a month or two ago, we wrote the city of Asheville and let them know this landlord has put our very life on the line & we told the city officials we were allergic very much to wasps and could be killed if we were attacked by them.. It's getting warm here down south, and soon the wasps will be out again.
the City of Asheville, though there are state laws (I can post those later) that insist you must provide a safe dwelling place for your tenant, has insisted that it's OK, for the landlord to do NOTHING about these dangerous insects, because they claimed they were "outside" pests, though we told the city inspector of housing & safety that we were allergic to these insects and could die if enough of them, stung us! Well, if they making nests in the attic, obviously they are INSIDE the house, not outside. We couldn't even open up the door to the attic now. We could be killed! I also informed the housing safety inspector, that the wasps were building nests right OVER the frame of the doors! So, they know it's dangerous, but they've not done anything, but suggest a housing inspector come out and see it, and then they could "possibly" do something.
Well, we don't have the luxury of "waiting" for the city inspector, if every time we open up the door, we have to worry about a swarm of wasps or hornets attacking & killing us. I think this city is being negligence, myself, but that's opinion, and no one really cares around here it's clear.

You'd think they would have contacted that LL (landlord) right away. WE have a medical condition, too, where we cannot run, let alone run from a whole swarm of deadly insects.
I cannot get anyone to help us! I'm afraid I'm going to lose my life soon, but the city doesn't seem to care!
They've violated our civil rights countless in this state. This state has been known, on many many occasions, for postponing any action, that would help keep people safe, in our state, as we've seen with our own eyes.
Countless people have complained about the lack of sidewalks here, and how you cannot safely walk down a street here in Asheville, due to the fact, there's no safe place to walk.
Yet, this city claims to be a "green city" and one that provides a "quality of life" , that's what it says on its website.
It's harder than finding a needle in a haystack to even get a lawyer around here to discuss your case, let alone find a good lawyer. There's hardly any good lawyers we know of in this area. They're far away in Charlotte, and we cannot travel that far.
we even contacted a lawyer out that way, one who seems to fight for people's civil rights, and told them the situation, but all they did was respond and say they couldn't take the case.
Now the landlord is retalitating against us and this also is in violation of NC landlord/tenant laws.
even when we write him a certified letter, he'll just ignore all the pleas to fix something, many of them dangerous things that ought to be fixed right away.
It would take me 2 weeks to list all the things he refused to fix, and all the ways he's put our live in danger (like immediately in danger).
This guy is a dangerous landlord to deal with. Why he has no concern for our safety, our friends' lives, is beyond me, but he's very wealthy too, so it's not like he cannot afford to pay $85 to save his tenant's life.
What can we do? Contacing the local news station does no good. Tried to contact a national civil rights organization, and they said they couldn't take the case....
Obviously our civil rights are being violated here.
I mean, don't we have a right to stay alive in the state of North Carolina, and be safe in the place we are paying our rent off promptly and on time?

Whom do we contact or try to get help from? I cannot afford to spend thousands of dollars either, on lawyers fees. I'm afraid soon we'll be paying for a coffin for ourselves, if nothing is done.:mad:What is the name of your state (only U.S. law)?

It sounds like the cheapest solution is to get help from the exterminator for $85.

With all due respect, as someone who is also deathly allergic to venomous insect stings, I would not hesitate to pay the $85 for the exterminator first and then pursue legal action (if at all) against the LL.

And if you have children, it's even more important to resolve the immediate threat (rather than wait for said LL to resolve it for you). Allergies of this nature are often hereditary in nature and often arise without warning.

At the moment, it seems that you're more determined to pursue a principle than you are safe-guarding your health/safety. :confused:

You know you have a dangerous allergy and you have been prescribed an immediate treatment. It's your responsibility to have it on hand.

If you think your lives are in danger, move. Seriously. Move.

I agree. If you are in such fear for your life be sure to buy the prescription the Dr. wrote for you. It will save you from "certain death":rolleyes: in the event you are stung.

What is your life worth to you, and that of your family? Surely $85.00 !!

Pay the exterminator and if the LL refuses to reimburse you consider it cheap life insurance.

Not filling the script and refusal to carry a Epi-pen kit are not good choices So lets follow this line of logic, LL or you arranged for extermination , job all done , yard is great to use. then a bee from the next door neighbors yard flys over and nails you and you still dont have a epi-pen kit, now who is responible for any avoidable complication with this allergy , time delays in treatment ? the nieghbor ????? as tenant no matter where your going to live part of consumer choices are to learn if local laws address a issue or not when its not clear in a lease.

OP appears to have contacted every official and organization for miles around (not to mention at least several internet forums) in an attempt to find legal justification for the landlord to pay for an exterminator.

Local officials have provided them with the information that it is not the landlords responsibility to address insects outside the residence nor is it the landlords problem that these tenants are allergic to wasps and hornets.

Seems much easier to fork over the $85 for an exterminator and get the problem taken care of.

Seriously, OP - you haven't done what's needed to remain safe, either. If you don't want to help take care of yoru own safety, why should anyone else?
