I live in Texas and im going through a divorce. We have been married for three year and never lived together, not has he taken care of our child who is 19 monhs. I did ask for help and husband refused to help because he has custody of a child from a previous relationship and cant afford to take care of both kids.I have done everything for our child. he did start to buy formula twice a month but kids need more than formula. I filed for child support and then he started giving me a small amount of money every time he got paid, but did nothing but buy formula before i filed for child support. Since we never lived together and i own and he rents, hes asking for his share of the equity from my home. We had to go to mediation and he offered me some property in exchange for back child support and him not claiming the equity on my house. I was urged by my atty and the mediator to take the deal and i did but i regret it. They both told me if a judge decides he will get the money for equity and the judge will split everything as he sees fit, so its better to agree. Also for visitation he wanted one night a week and two weekends per month according to his scheduled off days, we both work shiftwork. I need to know if the visitation agreement starts now or does the child under age 3 law affect our agreement. I asked my atty and he gave me two different answers. Divorce decree was signed yesterday an its on the way to his atty. Help.
