What is the name of your state (only U.S. law)? il
My wife and I split up back before we got married for 2 months to make sure everything was what we wanted. While we were split up she signed a piece of paper they printed ofline for temperory custody of her son. Not mine I am the step father. It never went through court or anything they just it noterized. It was so her mother could get a medical card and get some help with her back. (I know it is not right and I didn't agree with it but I couldn't do anything) Anyway. We got back together after being apart for two months and we quickly got engaged again. She lived with her mom while we were apart and she still took care of the child. When we got back together she moved in with me and so did the child. but the temp custody paper was still in effect. We got married and went and had the temporay custody revoked and her mother filed to take full custody of the child from us. we went to court and the judge ruled in our favor. she has now filed to have the judge reconcider. It is costing us a fortune to keep our child. How long can she keep fighting this and what can we do to end this sooner?

A motion for reconsideration is something that judges routinely deny without even having a hearing, so I really wouldn't worry about that much.

This is NOT your child. Did grandma serve the child's ACTUAL father for custody? Were YOU actually made a party to the case and awarded custody?

I know that leagally and biologically he is not mine but for 3 of his 4 years I have been there. He feels like mine. I know that there isn't really anything I can do. I am looking for information in support of my wife and to try and keep my family together. The real father ran off during pregnacy and no one has been able to locate him. We have tried and so has the state of IL and KY for child support reasons. The grandma is on bipolar meds and she hasn't been taking them. She is getting worse everytime the judge sides with us. I am being serious on the medication.

I notice that you IGNORED my question. Did grandma serve dad? I don't care what this child "feels like". Doesn't matter. Did grandma SERVE dad?

IF Mom brings that up at the hearing. Mom needs to move to have the request dropped on that basis - it's not automatic.

Wouldn't they still need to try service by publication (if that's allowed in their jurisdiction)? I can't see a judge just taking Grandma and Mom's word for it that Dad can't be found. That would be a very bad precedent to set.

Never count on the judge catching something. Mom needs to object.
