What is the name of your state (only U.S. law)? FL

I know this has probably been answered but wanted to confirm the answer.

Is it mandatory to be paid overtime?

I am paid hourly.

I work 4 -12 hour shifts total of 48 hours in a week.

Would there be any way the employer wouldnt have to pay me overtime wages.

Yes there are circumstances where you would not have to be paid overtime.
I work at 1 job where I work 32 hours the first week and 48 hours of the second week. I didn't get paid overtime

Not knowing what you are doing or whether you are classified as "exempt" makes it impossible to determine if you are due overtime or not. There are some exceptions to the overtime requirements for certain types of work. An exempt employee also does not have to be paid OT.

Unless you work in the medical field, that's technically illegal. With limited exceptions in SOME medical positions, overtime stands on its own, week by week. In the above situation, you should still have been paid OT for 8 hours.

I am a customer service rep. I basically take incoming phone calls in a sales environment.

Yes, you should be receiving overtime if you work over 40 hours in a week. (It's got nothing to do with the length of your shift - only with the total number of hours per week.) The problem is, FL does not have a state DOL. You can report it to the Federal DOL or you can file a small claims action.

Really? I was young...It happened both in the medical field and when I worked in manufacturing.

It is not how many hours you work in a pay period; it is how many hours you work in a single week. Overtime MUST be managed on a week by week basis, even if you are paid bi-weekly or semi-monthly.

Not your question, but just as an FYI since there is much confusion on this point; OT is calculated on hours WORKED, not on hours PAID. For example, if the company is closed on Labor Day but you get paid 8 hours of holiday pay, and then you work 4 10-hour days for a total of 48 hours, you are not eligible for overtime because you did not WORK over 40 hours, even though you got paid for 48 hours.
