my name is amber, i live in British Columbia, Canada. I am 17 years old, and my mother has run into some problems she didn't cause herself. I have a 6 year old brother who has no father anymore, me and my mom are his only family. If my mom was to be sent to jail, and my brother be taken away. Is there any way that i would be able to become his legal guardian? we have no other family members and i would be the only one other then an adoptive family that he could go with, plus he is my half brother, we have different fathers. I've read that the age is 18 to adopt, I know im only 17, but i turn 18 at the end of 2011 and im very responsible and have lived on my own for a year now. I just need to know that there is someway i can keep me and my brother together if my mom does leave.
anything helps, thank you.

The forum deals with US law only.

Fairly positive i wouldn't have wasted my time, if it said it only deals with US laws. It says Canada aswell.

That whole question you erased "What is the name of your state (only U.S. law)? " does not say Canada.

Illiterated uneducated minors do not get custody of their siblings. But good try. Stay in school and learn to read.

Please feel free to contact a local attorney.

(But if you were in the US, you'd have virtually no chance. An inexperienced 18 year old versus a verified foster family? No question)

You're welcome.

An illiterate uneducated one as well. An 18 year old COULD POSSIBLY get custody but that depends on the STATE. And guess what -- Canada is not a state of the US. Hence with the "Only U.S. law" thing -- yeah... Canada does count.

Despite me being physically closer to Canada than about 99% of other folk...

Yeah. Canada isn't part of the US. And the laws vary drastically. I hope OP takes the time to learn.

(And doesn't pull an attitude again)

I ask for help regarding a problem that will effect the rest of my life, and i get this. And thank you, i'm in the best university in Canada plus i work full-time, and i graduated high school 2 years early, i've been the only one supporting me and my family for over a year now. Thanks for your extremely unhelpful input. It's great to know people care so much.

Great. You are bragging so much but yet you have shown you can't comprehend anything. And such a mouth on you. Swearing at us? Seriously little girl, grow up. You are nothing but a child.

Oh and adoption is NOT the same as guardianship/custody. Your ignorance is showing constantly. Please come back after you have had a nap and weaned from the nipple.

Amber, for the record, I am Canadian. I live in the US, but I am Canadian.

The laws in the US and in Canada are not the same. The reason this website deals with US law only is that we do not have experts in Canadian law here. It would do no good for us to answer you with US law because it's not the same as Canadian law. The fact that you were told to make it clear if you were posting from outside the US does not mean that you are guaranteed an answer.

In any case, the posters here are all volunteers. They do not get paid for this and they do not owe you an answer. We do occasionally have Canadian responders drop by but they don't like responding to attitude any more than the US responders. So if you expect to ever get an answer, I suggest you lose the attitude pronto.

<---Not American, child.

You are quite obviously nowhere near mature enough to be having custody of a child.

Fair enough. However, I think you're misunderstanding that. It simply says that you're free to post if you're outside the U.S., NOT that the forum discusses non-U.S. issues.

For example, it sometimes happens that someone will live in another country, but have an ex and a child who live in the U.S. Since the child lives in the U.S., it is our laws that matter, but the person who lives outside the U.S. clearly has an interest in getting answers to their questions. So they would explain that they're outside the U.S., but have a question on U.S. law.

No one here knows Canadian law (or, at least, I doubt if anyone does). So even if you got an answer, it would not be helpful to you.

Google 'canada custody forum' and you'll find some forums similar to this one that discuss Canadian law.
