I need legal sources like other cases or Laws that say it is okay as long as they are not abusing HELP

Why? Do you need laws that say it's OK for them to drink water? Or laws that say it's OK for them to drink beer? Or laws that say it's OK to paint their toenails 10 different colors?

It's legal. You can't do anything about it unless the person is abusing it - and even then you have to prove abuse AND that the abuse is harmful to the kids.

I believe that custody goes by federal law and marijuana is a state law that is not a federal law actually federally its still illegal.. thats why i need laws that say its okay as long as it is not endangering the child

Are you going to federal court for custody.

No.

Custody is a state matter.

Look, if even these most basic concepts are beyond you (or the parent, which I suspect is NOT you), then an attorney is needed.

Parents are assumed to BE fit unless and until they're proven to be unfit. So it isn't up to the 'smoker' to prove it's ok. It's up to the OTHER parent to prove that the 'smoker' is unfit.

Therefore, you don't need a law saying it's ok (as laws do not, generally speaking, tell us what's ok), the OTHER party would need a law saying it's NOT ok. In CA, they don't have that.

If you love your kids, quit medicating. California family law will not give a damn if u have a rec. or not. It's still considered illegal in the federal governments eyes.

Please, stop posting. You obviously don't understand any of the issues involved.

The federal government has absolutely nothing to do with custody.
