What is the name of your state (only U.S. law)? TEXAS

My nephew's friend got into trouble and was losing custody to CPS of her newborn child. Her three other children were already placed with other families. CPS gave her 24 hours to place her in a qualified home, which she couldn't do. My sister gave her my number and she text me when CPS was already filing paperwork. CPS checked my background and agreed that i qualified for temporary voluntary care until she passed all her necessary requirements, and got a job and her own apartment. After 10 months she finished her classes but has not gotten a job or an apartment. The only time she visits the baby is when she drops off WIC, for about five minutes. She doesn't call and rarely texts to check on the baby.. I found out that the mother also leaves one of her other children that she just got back, with her grandmother who CPS found unqualified. I asked her to help babysit while I work so she can bond with the baby, and she told me to let her take the baby for four days.. so she can bond on her own. She says she's allowed to have her on her own now, But my paperwork shows supervised visits only. They also told me that I'm responsible for the baby and can return her when I feel she has done everything she has to do. From what I see with my own eyes, She stopped trying and is now partying and has been in jail for fighting at a bar. She is driving around without a license, probably no insurance, with her 2 year old in the car. She is 21, and I don't feel like she is trying anymore. She always has some excuse not to come spend time with her. The babies father was in prison while she was born, and now is in the halfway house, and will be release sometime in June or July.

For the last 10 months she has bought pampers one time, and gave her 2 outfits. I buy everything she needs and ask for nothing.


My question is, What can I do? What do I have to do? Do I have a chance of custody?

Does Dad want custody?

Why was he incarcerated?

if he goes back to mom, he'll ruin his chances. if she is refusing to follow the safety plan...they'll give dad a shot...but he would have to follow hteir safety plan as well, which will still include not leaving the child with mom unsupervised. those situations usually don't turn out well.

That might be a problem. Even felons can have custody of their own children.

I do think you need to speak with CPS, and a local attorney. CPS might actually be your strongest ally here, if Dad wants to fight.

Yes, I think you have a shot at custody - but your chances will probably be increased with an attorney and CPS on board.

On a non-legal note, thank you for stepping up and helping this child. :)

CPS pretty much told us once the case is closed, they aren't involved anymore.. They pretty much told us we are on our own.

I tried calling the case worker last week but he hasn't responded.

then talk to an attorney. you have status quo at this point.

now...it may not be forever...but you can file for temp custody. with a visitation schedule for mom AND dad. working their way back to full time custody.

and also, thank you as well for stepping up.
