What is the name of your state (only U.S. law)? NC

Hello everyone,

Here it is:

Divorce and CSO originally in NY in 1996 . Mother and child moved to NJ. NCO is in NC. He made a foolish mistake in stopping his payments when the child turned 18 2 years ago. NC is just now coming after him for non payment (court case is in Feb). He is willing to pay if it is indeed shown that he should have been paying all along. Here is the question. Which state has CEJ (continuing exclusive jurisdiction) over the child support? NY, NJ, or NC? Which guidelines should be followed for his case? Any and all advice is greatly appreciated!

And who are you in this situation?

If the order had never been modified or registered for enforcement or modification in NJ, then NY would still retain CEJ, though it sounds like NY has requested NC register the order for enforcement if NC is the state pursuing him for non-payment.

NY would likely continue to have jurisdiction over child support, since that is where the divorce was done and the order was made. Child support goes to age 21 in NY. NC is currently acting on NY's behalf.

I am a friend of the NCP. I have dealt with child support issues in the past with my own husband and he felt that I would be able to offer assistance. This forum has helped me and I thought may be that you in the community would be able to help him as you have me. Is it a problem that I am not directly involved?:)

Yeah it is a problem that you are posting for a "friend". "friend" shoud post for themselves. One should not presume to post anothers LEGAL issues on the net. Jus'sayin'/;)
 
Also, thanks for the advice been given so far. Another question? If NC is acting on NY's behalf, then should NC be following NY guidelines? When it comes to duration, even though it states in then divorce decree that it continues until 18 years of age, does he still have to pay until he 21 years old? Thanks again.

Unfortunately, he has no internet access, much less a computer, so I told him that I'd do the research. He did give me permission to post on this website when I told him how astute all of you are with regards to what I needed to know. However, you are right! If he could post for himself, he would and should do so. Glad to know that "due diligence" is still practiced!:)

If NC is enforcing the NY order, then the NY rules regarding emancipation are the one that rule here.

I am sure the local library has free net. Or you could let him use yours when he comes home. :)

That would be great if he had a vehicle and lived near me. LOL Thanks again everyone for the information. Some of the websites about child support law are hard to understand and I knew you guys would be able to help me.:D
