hi everybody,
hope I will get guidance..Here is my case....
I have been living in USA for about one year as a dependent of F1 visa holder.Recently I got my I-20 and now I want to change my visa status from F2 to F1.I have only 2 months left to start my classes.And I have some Questions regarding changing visa status...

1. Should I file to change visa status from USA? Is 2 months period is sufficient?What are my chances of getting F1 visa?

2. what are the chances of changing status if I file from India?
In case, my visa status does not change,will I be able to come back in USA on F2?Can they reject my current dependent visa?



please.. help me with these questions.I will appreciate if somebody could advise me...

You can only change STATUS within the US, if the petition is approved; you CANNOT get a VISA within the US. That can only be done through a US Consulate abroad.

Thanks for your prompt reply. I mistakenly wrote visa change. I mean to say is change of status from F 2 to F 1.
So i my question is

1. Should I file change of status from USA? Is 2 months period is sufficient?What are my chances of getting F1 visa?

2. what are the chances of changing status (from F2 to F1) if I file from India?
In case, my visa status does not change,will I be able to come back to USA on F2 ? will they reject my current F2 visa as well?

1. No, there is no guarantee that it would be adjudicated within 2 months. You should plan on 3-5 months, to be on the safe side. You can certainly apply for a change of status in the US. If it is not approved, you can always try for consular processing.
2. If you go abroad, there is also no guarantee that the F-1 visa will be issued. It all depends on how legitimate your application for the F-1 visa is and how you satisfy the criteria for getting this type of visa issued. If you are denied the F-1 status, there is no reason why you should not be able to come back to the US in F-2 status.

I got a yellow notice

Hello,
I came to US on Sep 2013 with an F2 visa and for summer 2014 I got admission for PhD from a School. They gave me a tution waive and 10 hours teaching assistantship. I applied for my status change on 28th Feb. After 3 months I got a yellow paper which is telling me though I got a tution waive and an assistantship still I have to show them the whole amount of money ($30,800). I have to have immideate availability of money,which make no sense. Also school is confused,since they are not charging any fees from me moreover they are giving me money for my other expense.

Also, I need to send a solid proof of residency where I will return after completion of my study.

What should I do?

Also I want to know is there any probability that USCIS will cancel my status chage application that's why they are asking for so many documents?

A 10 hour TA is unlikely to provide adequate funds for living expenses. You need to prove you have money available BEFORE starting school.
