I was involved in a MVA where from the best of my knowledge I had basically fell asleep at the wheel of my company truck and that statement in itself is another question but we will see if anyone warrants it or could answer it. After the accident I reported it right away to my appropriate manager and also called and made an appointment with my doctor as I was very rattled that this had happened and thank goodness it was only me involved and mo one was hurt unless it was me getting whiplash from a previous broken neck almost 2 years prior but have always had problems with my neck after i broke it. So my Dr pulls me off work and I asked my employer if I could go on FMLA as I did before when I broke my neck and I was out 4 months when that happened. They told me my FMLA is or was approved and not once this time or the last time I was on FMLA did they tell me anything on what or how it works and after reading into it this week it looks like I technically do not qualify as though I work for a large International company there are less than 10 employees out of our branch in Mpls. I even received a letter from a 3rd party telling me my FMLA was approved through October and I was totally lost on that letter but Aetna administers the STD/LTD and the letter I received made it sound like my employer had switched carriers for STD/LTD benefits but found it was not it was a Absent management system that was changed and in learning this as I thought the STD/LTD carrier had changed when it actually had not. I also would say on 5 separate occasions from the end of May to mid August I emailed the Human Resources Manager about possibly dropping my medical coverage reason being is Aetna has done everything they can to delay paying on my claim and since Memorial Day I have only been paid ONE TIME from Aetna and that is why I was asking about dropping the medical as my portion due to keep my Life and Dental and whatever other coverages I opted for would be like 120 dollars a month instead of almost 300 dollars a month, one time she told me she would have another person get back to me who never did and I emailed her back letting her know no one ever got back to me and I was quite nervous about losing my coverage as I had not been able to pay for it due to Aetna's total disregard for myself and my family in not wanting to pay though they have approved and I literally got a check TODAY which is my second check since Memorial Day. BUT I got a letter from a company that must handle my companies COBRA explaining or collection of money for benefits while being out on disability and this letter on AUGUST 27TH and it stated i had lost the loss of coverage for my Medical. Dental. Vision. and any extra insurance I had chosen for myself and there is a box for each insurance I had that had COBRA related that says why the coverage was terminated and it said TERMINATION OF EMPLOYMENT in each box with the TERMINATION being JUNE 6th (which I do not think it matters, but it was not even 9 weeks into my 12 weeks of FMLA). Should I not have been made aware of this back on June 6th or 7th that I was being terminated instead of learning through a 3rd paty Absent Management company, or even one of the SEVERAL times I emailed the HR Manager whom never would answer the questions I had and I also emailed her on August 27th asking her to clarify if in fact my employment was terminated and her reply was that she will look into it and get back to me which of course she didn't and I have BC'd myself to my personal email the responses she puts and never hearing back after even emailing her saying I never heard back and I really need to know about this and other questions I had only to never hear back, I did attempt on 1 or 2 occasions to call by phone but was unsuccessful in that and besides I also wanted proof on paper of my requests as I have had emails disappear from my inbox before and that was even one of the questions I had about missing emails out of my in box as we were told to keep what we wanted in the in box as if we deleted from it that it would automatically delete from everything but our in box every 30 days and this has happened before back in 2012 where I had lost emails from my inbox with NO REASONABLE explanation offered at all. SOOOOOOOOO do I have a case at all?
