My soon to be ex has been gainfully employed by the same company since 2008, while I was a stay at home mom for our entire marriage (eight years). I filed for Divorce in August 2015, all divorce proceedings were 'put on hold' due to him having pending criminal charges, no temporary orders were entered other than child support (figuring out my attonrey is worthless!!!). Now that we are finally moving forward with the divorce, he is claiming he has lost his job. He has not paid the mortgage on the marital property where myself and his children reside (granted in a protective order and temporary sole custody order) since December 2015. He also has not paid the car loan on the vehicle I drive (loan in his name only, title in both names), however continues to pay the loa on the truck he is driving. He CLAIMS to have lost his job, but I hired a private investigator who has recorded him coming and going from his place of employment for the last three weeks. I suspect he is making these false statments in an attempt to avoid paying alimony, as well as to allow the marital home to go into foreclosure (his name only on loan, both names on deed) to avoid me having any interest to gain in the sale of the property. What recourse do I have if any?
He also recently purchased another vehicle for himself, securing a loan of over $7K....is that considered maritial property as well, even though it was purchased after the petition for disolution of marriage?
