Access to School Enrollment Forms - OHIO

What is the name of your state (only U.S. law)? Ohio (Hamilton County)

My ex has full legal custody of our daughter, and I have standard visitation and access to medical and school records. Order states "Father is entitled to access under the same terms and conditions under which access is provided to Mother, to any school, daycare, or child care provider record that is related to the child(ren) and to which mother is provided access".

I have asked for a copy of our daughter's original enrollment forms as well as the emergency contact forms mom provided. The school has stated that I am not allowed access to any forms that mom originally filled out.

Is this correct? I want to push back, but I also want to make sure that I am not violating any kind of privacy laws in the process. The school has been great with me over the past year, so I am not sure why there is a push back on this issue.

Look at 3109.051 (G)(H)(I)(J)(K) for your rights without custody. And then call the superintendent of the school district and tell them what they can do with their illegal activity.

OP, quote the law and tell them you will take them for contempt and ask for jail time for ANY individual who has blocked your access. make sure you get their names and positions. The law allows for that and YES in Ohio that happens.

I looked at the code sections you cited and I'm hoping to get some clarification. The code sections all seem to state "...under the same terms and conditions under which access is provided to the residential parent, to any record that is related to the child and to which the residential parent of the child legally is provided access...". So it appears that, if the school can legally refuse to provide the residential parent access to certain portions of the information, then they can legally refuse it to the other parent also. Federal law allows access to "educational records" and the items that the OP is asking about do not seem (to me) to be "educational records". Does OH law expand the access that the school must provide?

Yes. Because the residential parent was given access to that form to correct it, check it and update it and even have a copy of it. Therefore, the other parent also gets access to that form. It is also part of the child's file at the school. Hence it is part of the educational record.
