What is the name of your state (only U.S. law)? SC, Hello need some opinions. I work for and automotive company and recently I attended a team event with my coworkers which included my supervisor, our department manager ( supervisor boss) and his boss. We all were having alcohol drink and eating. On of my coworkers who smoke cigarette asked me if i wanted to go out to smoke. I smoke cigers so i said yes. When i came back, the department head said the he saw me smoke and went me to take a drug test, my supervisor comment the same request saying also that he noticed I keep my hair cut short. These comments were all in from of 7 other coworkers including our higher manager. I am an black man and feel this was profiling. They did say the same to the other coworkers who is Caucasian. I will take a test but not because of profiling and the fact the drinks that night was purchased by the department manager. Any reasonable suspiction was due to drinking. Monday I have a meeting with my supervisor and feel a test request my come up. What are my options. Thank you

Could the reason they were concerned be the type of cigar you were smoking? There are some types that are very commonly used as a method to smoke marijuana.

I agree, there is a type of slim cigar that young people have been using to smoke marijuana.

It was a premium ciger you would by at a high end ciger shop. Nothering like the gas station cigers. And need to correct a typo. The didn't say the same to my coworker.

Also i have to question their thinking. How would some would think a working would smoker weed in front of another cowork only feet away at the restaurant where everyone can see. That inappropriate thinking process

It may be inappropriate thinking process, but it doesn't change the fact that they are permitted to ask you to take a drug test. There's no obligation to treat everybody identically. As long as they are not discriminating based on a protected class, they're free to be arbitrary.

It sounds to me from this distance as if they may've been being sort of snippy to you, perhaps they'd like to get rid of you. Drinking alcohol on the job or at a job connected function is rarely a good idea. It may have loosened their tongues and lowered their judgment making capacity to the point they were a little insulting, but I do not see a single thing that happened that you could sue them for EEOC violations or make a complaint against them simply because you are not Caucasian and they are and you felt you were singled out. Maybe they just don't like you. If forcing you to take a drug test means you get all insulted and quit the job, you'll find yourself out of a job and with no discrimination complaint and no unemployment benefits until you find another job. Go on and take the drug test, if they follow through with it, and keep working until you find another job if you think you've been mistreated and irretrievably disrespected.
