What is the name of your state (only U.S. law)? Pennsylvania . I recently was promoted to assistant foreman. That means I am no longer union . . Not sure if I like the new position and was wondering if I would be able to go back even if they hired a new guy for my spot . The union contract says that seniority rights accumulated while in the bargaining unit shall be retained by an hourly employee promoted to a position outside the bargaining unit for a period of one year

I doubt your employer has any obligation to move you back to your old position.

Assuming what you quoted is what the contract says about kept seniority I would assume that if you did go back to a union position within a year you would keep your earned seniority. It says nothing about any job right or that they have to fire someone they have already hired to give you a job.

Nope, plain and simple, it means that IF you go back within a year, you retain your seniority. It doesn't mean that you have to be allowed to go back.
