Hi Guys, I need your opinion/help on this case. So I got married in late August in NJ ( Im from NY).I hired a business in New Jersey for wedding rentals. I rented a dance floor that cost $600 dollars. I have email proof of the dance floor & payment. I requested with a picture sent to them asking them if they have this. Sales rep exact answer was copied pasted " that is basically the exact dance floor we have that you sent a picture of" I have a whole email thread about me making sure that there dance floor would be sturdy etc.
So I paid them by check.. fast forward to the day before my wedding they dropped the dance floor and put it together at the venue. The venue groundskeeper was there. I was not there. (Day before the wedding things are hectic I was travling for Ny to NJ ) So i only got a chance to see the venue 11pm at the night with the grounds keeper. I flipped because 1) it was not the dance floor i requested. 2) it wasnt even installed properly 3) it was bumpy and not safe for my guests to dance on. it looked so cheap too. The grounds keeper agreed, she said she didnt want to say anything to them because maybe i did pick this dance floor. I told her no way. I got ripped off. This was not what i requested. The Business was closed so we had to call them the day of our wedding. My husband and I couldnt do this obvously so we told our best man who is awesome to take care of it. I forward him that email from the company stating about the dance floor. He called them up and he started to complain. Saying we dont want this we need you to remove it. 1) because its not the dance floor requested 2) because its unsafe for people to dance on this.3) saying we wanted a refund. The rental company said they can fix it, Bestman called me and asked me i said NO. Fix what? 1) it was the wrong dance floor theres no time to fix anything.
They dont have the dance floor i needed and im dissatisfied as a customer to deal with their bull. i dont want my guests to see people going back and forth. It was a disgusting dance floor . My ceremony/recption was all in one location. Fast forward we got permission from the phone call to take the dance floor out ourselfes. So we never used their dance floor . We had no dance floor. Lucky the venue redid its floor so we were very lucky we didnt really need it. After my wedding i went straight to my honeymoon overseas and i came back and called the company. 2nd week of september to follow up on the promise of a refund I was meet with a nasty employee who lied to me over the phone never called me back and saying we dont have a record of this. So i found the number from my bestman and who he spoke to the day of the wedding.
I found out that this guy doesn't even work for the company and that the company bought the dance floor from him. Then i called the company and finally after mentioning all this First he said they would not refund me back. He said that was coming from the owner. So nicely i ask him. May i speak to the owner. Then he says im the owner. WTF. He wasnted the owner mind you, he told me he was the manager. I flipped out, because this guy was humilaitng me over the phone. i let my husband take care of it from there, he called them up threated them with legal action if we dont get our refund .
Finally the REAL owner calls us back after being scared. He admits his wrongdoing but will not refund us because it took us so long to call back. I said we were on our honeymoon and in the contract doesn't state anything. We had a contract and your company did not deliver I told him and we voiced about our refund the day of the wedding. I told him what his employee told me he had no words to say. I recorded our whole conversation because i really dont trust these people after what just happened on the phone. They are decieving. Our wedding was 8/25/17 and we called him Second week of september expecting our refund. he claims the bestman never asked for a refund which is a lie. Our bestman will give us his statement. He doesnt even meet us in the middle for a partial payment until i brought it up because he knows he is wrong. Only 200 dollars which makes no sense. so we told him we would take legal action 600 isnt alot but the way they spoke to me and the games they played over the phone is worth it.
Can i file in NYC if the business is in NJ? I want to make it the most hardest for them let them travel to a nyc court if possible? What do you think about our case? Can we use audio recording? I first plan to do a settlement demand letter with a lawyer then small claims court.
