extended summer possession before school is released

Mom requested her 2 weeks of extended summer possession to be the last 2 weeks of april which are before our ISD is released for summer break. I originally agreed via text to this, but now I want to rescind the agreement. Our son starts kindergarten next year, and he has already been out of daycare this week because I let him spend time with her mom in another state. I want our son to be fully prepared for kindergarten and soak in as much education beforehand. Can i rescind agreeing to her 2 weeks in April? Our decree states summer is based on our ISD and that begins at the end of May. Mom is saying she will take me to court for being in contempt since I agreed.

You already gave permission. You will look silly in court if you forward the idea that 2 weeks of daycare in April is going to have any effect on the success of your child in kindergarten next year.

Pardon me, but is your child developmentally delayed and in need of some sort of special help to get ready for kindergarten?

If not, then this is not the hill to die on. Just use it as a learning experience and check the district calendar before agreeing to such things in the future, when he starts real school.

Yes he was evaluated by an OT and diagnosed as being below average in a lot of areas.

I will also add the OT report deemed his therapy medically necessary but his mom refuses to pay half because she doesn’t believe anything is wrong so kinderprep at his daycare is all he gets

Obviously you did not think it was important enough to pay for it all by yourself.

Seriously, you agreed to mom having the two weeks and you will not look good if you try to insist that your child not miss two weeks of daycare. Even if he is a little developmentally delayed its simply not going to fly.

Half the population is "below average". It does not mean that the child is developmentally disabled. Has the child been diagnosed with a developmental disorder?

Is he going to be in daycare throughout the summer?

Does your court order state that Mom must pay 50% of medically necessary items such as therapy? If not, then all you can hope for is a voluntary contribution unless and until you go back to court and get it changed.

However, if your court order does state explicitly that she is on the hook for such expenses, then by all means take the steps to enforce it!

I would worry less about missing those weeks of kinderprep and more about what help your son can get over the summer. He needs reinforcement of his new skills! There may be other services in your area. Your local library's children's room might know of some resources.

Finally, I applaud you on trying to address this before kindergarten. I have known otherwise intelligent people put this off, to their child's detriment.

If your child is sufficiently delayed, the public schools would have provided services - but not just daycare. I would also ask to have the child evaluated by a developmental pediatrician for a true assessment; an occupational theripist's evaluation may be helpful but is not sufficient to establish a proper medical diagnosis especially if it is an issue benefiting from medication.
