I'm seeking employment in Michigan and was far along in the process with my tribal organization. I'm a registered member of a federally recognized tribe in Michigan. However, I have 3 DUIs over the span of 20 years, and their HR person phoned to tell me that I'm disqualified from going any further, as their insurance company will not insure me. The job requires some driving back & forth between the two main casinos. They gave me no options.
However, as an active participant in the tribe's forums and meetings, I do have privilege in opening a can of worms and discussing some possible solutions. For example, I would like to propose drafting an employment contract that stipulates my operating a personal vehicle. Then includes a migration to a company vehicle if there are no further moving violations of any kind within two years.
Or, online, somebody wrote that an employee that drives to various locations in a personal vehicle and is then reimbursed mileage at the government rate. The company avoids the increase of insurance but is potentially liable for anything that happens while the employee is conducting company business. This option sinks me. Is it possible to mitigate company liability?
I realize that this issue many involve an attorney familiar with Indian Law, and the tribe is a sovereign nation, but it also happens at every company in the US. Some companies outright fire an employee who gets a DUI while employed if driving is part of their duties.
What other (creative) solutions could be proposed?
