I was recruited to join a CA based company, leaving a secure job in the process. After two months I was terminated the cause I was told was due to my not meeting performance metrics. Prior to accepting the role I specifically asked about metrics and was told "we (the company) still need to work that out" after starting the job I again asked the same question and was given a similar answer.
Point being that was a made up excuse and the real reason was my manager simply didn't like me. BTW I signed an employment agreement but they never returned a countersigned copy
After shipping their laptop back I received a severance deposit, a week later they called me to say they overpaid by $3K and want the money back. Also I never received a paystub for the money as it was direct deposited so I don't know how they came up with that figure
I'm without a job as well as health insurance and have a two month hole on my resume due to an incompetent manager. Am I obligated to send them back the $3K?
