There are investigations in North Carolina currently over the arrests of several individuals following their purchases of supposed illegal drugs from police department informants.

The investigations center on the evidence that is supporting the charges, which turn out not to be drugs at all. Some cases have already been dismissed over the false evidence and at least one police detective has been placed on leave.

So, while an arrest is certainly possible if someone purchases drugs from a police informant, the facts of purchase and the evidence must support the arrest and any resulting charge.
