Taking A Mechanic To Court

Car had check engine light on. Code stated I needed a new catalytic converter.

I found a repair shop with the best reviews locally (car is not under power train warranty any longer).
1. Cat replaced - a bad sensor code came on
2. Cat replaced with different cat and owner of shop damaged my 02 sensor so he put a used one one without my consent. This was because the new code can still be a bad cat.
3. Code came back saying 02 sensor was bad.
4. I paid for new sensors and took them to mechanic.
5. Light came on again.
6. I took the car to another mechanic shop. The code this time was the original code that my cat is bad. And the sensors were tested and work properly. Shop wrote in my e mail "Catalytic converter on bank 2 is faulty. Heat test performed on converter. 02 sensors are working per factory specifications. Bank 1 converter and 02 sensors work per factory spec. Recommendation: replace catalytic converter with Mopar part at dealership.".

I asked why and they told me that on my car aftermarket cats cannot clean my emissions to the EPA desired amount and they even stopped replacing them with any aftermarket because even if people drove on them, they would be basically toast in a few months.

I texted the mechanic who did the first work, all of this has happened within 1 month and all lights return within a day of the changes made above. So he has no e mail, I texted to have a record. I asked they pay for the sensors they broke. I told them I was using the dealer and not asking them to replace the part because on the phone they said they were not replacing any more parts. They want to turn my light off and I drive around like this. I refuse to do that.

I have been out about 700.00 I asked for 200 back with no text message back. I would like to sue them on the basis of they never fixed my car. They broke sensors and never offered to pay to replace them and threw some old junk on.

I only know what exactly happened as ai was there by the lift. Yes, they have no waiting area. In fact he struck up a welder right by me without even warning me and I went outside while they welded as fast as possible. So I watched him strip my sensor. I watched them switch out my converters. And I have this other shop giving me a pro opinion. I also found out after all this, while he used to work for exhaust shops for 20 years now he has his own he let his certifications expire. No idea if that matters.

He doesn't give written receipts nor estimates. However with exhaust I was OK with it as anyone can do exhaust of you know how to weld. It's the fact I feel I deserve something back on this job and they are refusing to even work with me.

I paid using my debit card. Spoke with bank and they said they would file something like a chargeback if I wanted as they seemed OK with me evidence. I was told debit doesn't have the same power as credit. But I chose not to as I read even if I won he might put a mechanic lien on my car then I'd be in court trying to strip that. So, my idea was if I have a Judge weigh in in small claims in my favor I can address that issue as well. It would be great to get my $ back as a Mopar part and labor is $2,200.00 but it is going to be EPA compliant and obviously for my car and safe and I think 2000 is a small price to pay to make sure my car isn't polluting everyone or possibly me and meet federal requirements.

What model car? Check engine light malfunctions are common in some vehicles, due only to the placement of the sensors and not due to any problem with the vehicle itself. The check engine light is prone to failure in these vehicles when they operate in damp weather or when water accumulates in the windshield wiper well.

The repairs to your car could be based on the mechanics trusting the sensor codes rather than questioning the reliability of the sensor.

lol... I am exposed to foul language every day.
BUT! On this site it violates the TOS and, frankly, if one cannot/will not control themself then one should hire an attorney who will be well paid to listen to the vulgar and abusive baby tantrum potty talk.

No argument there. Attorneys when paid well enough will put up with all sorts of nonsense from their clients. Haha.

Meaning that it might not be cost effective to make this repair correctly. At least, that's what my mechanic told me when those codes started showing up.

I don't think that you have a case to get money back. There was no fraud.
